Is It Illegal To Fly Mexican Flag Over American Flag?

    Here in San Diego this guy is flying the Mexican flag over the American flag. I told him it's against the law to do it that way and he doesn't care. Am I right? What can I do about this?

    While it does violate the Flag Code, a section of Federal Law that deals with flag etiquette, the code serves as a guide. The Flag Code contains no penalties for violations. In addition the Supreme Court has ruled that Federal and state laws which prohibit the desecration or mistreatment of the U.S. Flag are unconstitutional.

    It's not punishable by law, but it isn't very polite. Traditionally, a when a warship was captured in battle, the captor would fly the loser's flag under his own on the captured vessel to announce his victory. This is what the flag code refers to when it says that one nation's flag should not be flown above another "in time of peace."
